The driver of a hit and run vehicle that struck and killed a 13-year-old boy who was skating across a State Road 434 in Altamonte Springs Floriida. The victim was in a crosswalk and it was almost dark when he got hit in the car v. pedestrian auto accident.
The driver did not even have a driver’s license when he crashed into the boy. He tried to cover it up by leaving the scene, fixing the car and hiding out for several days.

The one year sentence is actually very light. According to the Judge since it was only an accident caused by negligence and not intentional he only gave a one year jail sentence. This is much lower than the State Sentencing Guideline sentence of 12 years and far below the 25 years requested by the prosecutor.

The family of the boy is not happy with the sentence. They lost their son forever and feel that the sentence is not enough. The troubling part to me is not the accident in that it appeared to be a case of negligence only with no drinking or recklessness. The reason the sentence is too low is that the man left the scene and tried to cover it up. He should have stayed and helped the boy or at least tried to do so. Therefore there should be a stronger sentence, not for the mistake that caused the auto accident, but for leaving the scene of the car accident and for the attempted cover up.
