Recently a very large jury verdict was entered in a case where one of the main issues was whether or not the drivir who caused the car accident was talking on a cell phone while driving. Currently, Florida has not legislation directly prohibiting the use of cell phones while driving. Further there is no specific law prohibiting the sending of text messages or emails or web surfing while driving. There are general laws prohibiting reckless or careless driving that probably apply to this conduct but there is no specific criminal or civil law in Florida banning the practice.
