Comments Off

A study conducted by Ross A. Klein, PhD, a Professor at Memorial University of Newfoundland, which compiled information from the years 1995 through 2007, reports that Carnival leads many of the major and non-major cruise companies in incidents involving passengers and crew overboard. Between 2000 and 2007, Carnival ship had 26 incidents involving “men overboard”. In second place was Royal Caribbean International with 17 for the same time period with dramatic drops in the numbers therafter.

Generally, when a claim for injury or death on the open waters is pursued, there are several hoops one must jump through. The ticket for the voyage many times is itself a contract which the passenger (like it or not) agrees to upon purchase. Also, many times, there are requirements that formal notice is given to the cruise line within a specified time period. Another common provision in the ticket contract is that the case must be brought in a specific jurisdiciton and venue.
